ASSESSMENT OF INDONESIA’S HUMAN RIGHTS PROGRESS AND CONTRIBUTION AS A MEMBER OF THE UNITED NATIONS HUMAN RIGHTS COUNCIL
THE United Nations Human Rights Council (HRC) was established in 2006 to replace the N Commission on Human Rights and redress its shortcomings, especially regarding objectivity and politicization. Indonesia served two terms in the HRC: first as an initial ember from 2006 for a one-year term, and second for a full three-year term from 007 to 2010. In 2011, Indonesia is planning to run for a third term of membership inthe Council. To that end, Indonesia must convince again the General Assembly of its ommitment to the highest standards of promotion and protection of human rights.
For that purpose, it is necessary for the civil society to have in hand a document utlining, first, Indonesia’s level of fulfillment of its voluntary pledges and commitments s well as recommendations from the UPR Working Group; second, a record of positions aken by Indonesia on important international human rights issues, both on thematic ssues and country situations.

PADA tahun 2010, dengan bantuan dana dari HIVOS, MADIA mengambil inisiatif untuk melakukan FGD (Focus Group Discussion) di Tegal, dan Cigugur-Kuningan, bekerjasama dengan pengurus HPK (Himpunan Penghayat Kepercayaan) dan BKOK (Badan Kerjasama Organisasi-organisasi Kepercayaan). Kedua FGD tersebut diniatkan untuk menggali dan mendokumentasikan pengalaman diskriminasi yang selama ini dialami para penghayat kepercayaan terhadap Tuhan Yang Maha Esa. Ombudsman wants Bogor church ban annulled
The Ombudsman’s office said the annulment that was issued by Bogor’s mayor on March 11 violated the law and disregarded a Supreme Court ruling on the dispute.
“The Bogor city administration should have adhered to the Supreme Court’s ruling, which is binding on the disputing parties,” ombudsman representative Budi Santosa said.
Based on its findings, the ombudsman recommended that the city administration immediately revoke the decree that annulled the permit.
“According to the law, the Bogor city administration is required to report to the ombudsman on the implementation of the recommendation within 60 days after the administration receives the recommendation,” Budi told reporters on Monday.
The congregation of GKI Yasmin has conducted Sunday services on a sidewalk near its half-finished church since April 10 in protest of the administration’s decision to seal off the site a month earlier due to public pressure.
Some Muslim residents who lived near the construction site previously alleged that church officials falsified their signatures when applying for the building permit.
The congregation succumbed to public pressure in January by temporarily holding services at the Harmoni public hall after Bogor Mayor Diani Budiarto vowed to open the church if the Supreme Court ruled in the congregation’s favor.
On Dec. 9, 2010, the Supreme Court overturned a lower court decision ordering that construction on the church halt.
Bogor administration secretary Bambang Gunawan recently told The Jakarta Post that the administration viewed the church building permit as illegal despite the Supreme Court’s decision.
“For us, the permit is illegal because the signatures required for the permit were forged,” he said.
The congregation resumed worship on the street near the church site after the Bogor administration showed no signs of obeying the ruling.
According to GKI Yasmin spokesman Bona Sigalingging, a multitude of plants and a wooden fence appeared on the sidewalk on Sunday, preventing the congregation from holding services.
“GKI Yasmin was forced to hold Sunday services in an open field across the street,” Bona said.
Ombudsman office chairman Danang Girindrawardana said that the GKI Yasmin case would be taken to a higher political level if the Bogor city administration failed to obey the recommendation before the deadline.
“The recommendation is the highest level order that the Ombudsman can issue. If the Bogor city administration fails to fulfill it in 60 days, we will leave it to the provincial administration. It could go as far as the Home Ministry — and even to the House of Representatives or the President,” Danang said.
Danang said that his office would monitor and cooperate with the Bogor city administration to implement the recommendation.
Bambang Gunawan said that the administration would try to implement the recommendation.
“We will study and try to carry out the recommendation optimally,” Bambang said.
“We have to be very careful because this is related to a matter of religion, which is very sensitive,” he added. (rcf)

500 Indonesians Detained in Australia Prisons

VIVAnews – Indonesia's Consul General in Sydney, Australia, Gery Yusuf, said that about 500 Indonesian nationals have been arrested by the Australian government and locked up in several penitentiaries for entering the country illegally. Indonesia's Consulate General managed to bring home three Indonesian nationals from East Nusa Tenggara out of the said amount who are minors.
“These three children could be brought home as they are categorized as minors. We managed to bring them home after going through tough lobbying and negotiation,” said Gery at Ngurah Rai airport, Bali, accompanying the three boys, Wednesday, July 13, 2011.
House to summon Bogor mayor
“We need to seek clarification from the mayor himself. We need to find out what are the problems that preventing him from obeying the Supreme Court’s ruling that runs in favor of the church,” legislator Benny Kabur Harman of the Democratic Party, who led the meeting, said on Tuesday.
Legislator Eva Kusuma Sundari of the Indonesian Democratic Party of Struggle (PDI-P), who was also at the meeting, said that a higher official might have spurred the mayor to refuse to honor the court’s decision.
“I’ve heard that even Home Minister Gamawan Fauzi himself stated that the ruling should be in line with the will of the majority. Thus, if a superior official had issued such provocative statement, then what can we expect from a mayor like him but to obey the minister?” she said.
Govt prepares 3 million jobs for migrant moratorium
The Jakarta Post, Jakarta | Manpower and Transmigration Minister Muhaimin Iskandar said that the government had prepared up to 3 million jobs in anticipation of an increase in unemployment due to a moratorium on sending Indonesian migrant workers abroad.“We will provide jobs to 3 million workers to anticipate [rising] unemployment during the implementation of the moratorium on sending migrant workers [abroad],” Muhaimin said as quoted by tribunnews.com on Tuesday.
Muhaimin said that the National Program for Community Empowerment (PNPM Mandiri) supported the effort to provide the jobs. According to Muhaimin, the ministry will also promote programs to increase production as well as efficiency and that an appropriate use of technology should be implemented in areas where most migrant workers come from.
Ombudsman Comes Through for Embattled Bogor Church
The Indonesian Ombudsman, which is tasked with overseeing public services, said Bogor Mayor Diani Budiarto must annul his previous decision to revoke the church’s building permit.
“The Bogor mayor didn’t show any commitment to implementing the Supreme Court ruling,” said Budi Santoso, a member of the body.
He was referring to a decision by the court that ordered the church’s building site reopened.
“The measures taken by the Bogor mayor represent more of a sociological approach that is not related to the court’s ruling,” Budi added
The Bogor administration had issued a building permit for GKI Yasmin in 2006, but revoked it two years later, alleging that the church had falsified the signatures required to obtain it.
In December, the country’s top court ruled in favor of GKI Yasmin, annulling the revocation. The city, however, refused to comply for fear that it would spark unrest, and instead offered an alternative location for the church. On March 11, the Bogor mayor revoked the church’s building permit for a second time.
During a meeting on Monday with members of the Bogor administration, the West Java government and the Home Affairs Ministry, the ombudsman chastised the city for ignoring the Supreme Court ruling.
“This ignorance could be classified as negligence with regards to the law,” Budi said. “Every action taken by the Bogor mayor must be in compliance with the Supreme Court decision.”
Budi added the mayor’s decision to revoke the building permit in March could be classified as “maladministration.”
The 60-day deadline to annul the decision is effective from Monday, Budi said. He added that the city government, the provincial government and the ministry were all bound to follow the ombudsman’s recommendations.
Bambang Gunawan, the Bogor city secretary, said after the meeting that they were ready to implement the ombudsman’s decision.
“God willing, we will follow up on this and try to implement this,” he said.
“And if we face any obstacles in implementing the recommendations later on, we will consult with the ombudsman. We’ll try to do our best.”
Under the 2008 Ombudsman Law, the Indonesian Ombudsman can report state agencies that fail to implement its recommendations to the president or the House of Representatives.
Obstructing investigations by the ombudsman is a crime that carries a punishment of up to two years in jail.
The United Nations has written to the Indonesian government expressing “concern” about the increasing number of reports of violence and discrimination against religious minorities, specifically mentioning the GKI Yasmin case.
House urges education ministry provide funds, migrant worker training
“The government should allocate funds for education and training for Indonesian migrant workers, during the implementation of the moratorium,” a member of the commission, Chusnunia, said in a press release on Tuesday.
The moratorium of sending migrant workers to Saudi Arabia will be effective on Aug.1.
Chusnunia said the commission proposed an allocation for migrant workers as the Finance Ministry planned to raise the National Education Ministry budget by almost Rp 14.5 trillion (US$1.6 billion) in the proposed revision to the 2011 state budget. The raise will increase the National Education Ministry budget to more than Rp 262 trillion.
